S.B.198 - Effective July 1st 1991PROBLEM:
Every employer shall and must establish and maintain an effective Injury and Illness Prevention Program. The Program shall be in writing and shall include the following requirements (Ref: Cal/OSHA Section 3203):
REQUIREMENTS:
- Identify the person(s) responsible for implementation of program
- Ensure that employees comply with safe work practices - discipline/sanctions
- Communicating all hazards to employees known to management
- Scheduled periodic inspections to identify unsafe conditions
- A procedure for investigating all accidents and near misses
- Provide initial and continuing training of all employees
- A system to maintain documentation on all safety activities
NOTE:..... Most Workers' Compensation applications now require proof of a site specific SB198 Safety Program, and under the new Workers' Compensation Reform Act (AB110) there is a much stronger tie in to safety regulations. Workers'Compensation data is now to target individual employers for safety inspections.
CAL/OSHA, since 1995, has been sending out letters to companies with an Experience Modification Factor (Ex. Mod.) of 1.25 or higher. The letter requests that the company to call Cal/OSHA to establish a review of their Safety Program by their Consultation Division or their insurance company, or consultant, and report back to them within a reasonable length of time. If they fail to comply, they may be placed on a primary inspection list, with the potential of the following:
- Fines up to $25,000.00 (serious citations)
- Potential civil and criminal liability
- Possible costly employer litigation
